Release, Waiver, Indemnification & Regulations Agreement

Welcome to Texas Hill Country Outfitters. We truly appreciate the opportunity to be your hosts. We take pride in the abundant wildlife and beautiful countryside that the Ranch offers. We look forward to sharing all the Ranch has to offer with you and hope to make your experience truly enjoyable.

The regulations listed below are very important for your safety, maintaining the quality of wildlife here on the Ranch, and avoiding unneeded misunderstandings. EVERYONE MUST READ THE FOLLOWING REGULATIONS AND ACKNOWLEDGE THE AGREEMENT. EVERYONE MUST FOLLOW THE REGULATIONS PRIOR TO PARTICIPATING IN ANY ACTIVITY ON THE RANCH.

• All individuals must check into the Headquarters House and sign a waiver.
• All hunters will be required to have and provide proof of a valid Texas state hunting license. Hunters shall carry said license with them at all times while on the Ranch. All hunters must comply with all Federal, State & County hunting laws, rules, and regulations.
• All hunters are required to REAFFIRM the accuracy of their firearms and/or bow at the shooting range.
• Safety is our primary concern, please make it yours and abide by the following:
• All hunters shall depart blinds above 6 ft. tall when the wind gusts above 25mph.
• All firearms MUST be unloaded before entering and before leaving all hunting blinds.
• Firearms and bows need to be VISIBLY unloaded.
• Guests are responsible for making sure of their targets and what is beyond their intended target prior to discharging any firearm.
• No guest, guide or associate is allowed to consume ANY alcohol the same day of any hunt, unless and until the guest, guide or associate have completed hunting for said day.
• Please be considerate of other guests. Excessive drinking and/or drunkenness is not to be permitted.
• Smoking is not allowed in cabins or Headquarters House. Smokers are welcome to enjoy smoking on the Guest Quarter decks and the house deck. No smoking in pastures including in the blinds or vehicles.
• No guest is permitted to be on the Ranch without an Owner, partner, or employee, unless prior approval by Owners. If a guest remains alone in a blind while a guide attends to other matters, the guest shall remain in their assigned blind. Guests are not allowed to walk around the Ranch unless accompanied and supervised by their guide.
• All Whitetail deer harvested must be logged. If the guide sees the bullet hit the animal, it is considered wounded regardless of any blood or tissue found. All wounded animals will be considered dead. NO EXCEPTIONS.
• All whitetail deer must receive a MLD Tag prior to being taken to processing.
• "What is on the Ranch stays on the Ranch" - Do not borrow or remove anything from the Ranch without prior approval by Owners. This includes dropped antlers, Indian artifacts, etc.
• The Ranch insurance does not allow guests to operate ranch owned vehicles and/or equipment.
• No firearm shooting from decks except for predators (mountain lions, bobcats, coyotes).

THE RANCH'S MANAGEMENT RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO TERMINATE YOUR HUNT AND STAY AT THE RANCH WITHOUT REFUND AND IMMEDIATELY ESCORT YOU OFF THE RANCH FOR ANY VIOLATION OF ANY RULE.

Waiver of Liability

Please read and be certain you understand the implications of signing.

Express Assumption of Risk Associated with Hunting and Related Activities:

I, do hereby affirm and acknowledge that I have been fully informed of the inherent hazards and risks associated with hunting activity, transportation or equipment related to the activities, and traveling to and from activity sites in which I am about to engage. Inherent hazards and risks include, but are NOT LIMITED TO:

1. Risk of injury from the activity and weapons used in hunting is significant including the potential for permanent disability and death.
2. My own negligence and/or the negligence of others, employees, agents, independent contractors, or representatives of Rain Creek Ranch, Anderson, Tuggle, and Anderson Families, including but not limited to operator error.
3. Discharge of weapons, whether accidental, intentional, or caused by malfunction of the same.
4. Exposure to outdoor elements, including, but not limited to inclement weather, thunder and lightning, severe and/or varied wind, temperature and all other weather conditions.
5. Attack by or encounter with insects, ticks, reptiles and/or animals.
6. My sense of balance, physical coordination, and ability to follow instructions.

I understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.

In consideration of being permitted to engage in any and all activity on Ranch (hereinafter referred to as the "Activity") coordinated by Rain Creek Ranch, Anderson, Tuggle, and Anderson Families of 1755 PR 506, Brady, Texas 76825 which I acknowledge is unsupervised, I acknowledge and agree to, on my own behalf, and on behalf of my personal representatives, heirs, assigns, executors, administrators and next of kin as follows:

1. I am aware and acknowledge that injury or death may result from my participation in the Activity and from the use of the premises and facilities where the Activity is located or is to occur, or if premises and facilities are not applicable description, the general area where the Activity is to occur, and the use of any machinery, equipment or apparatus located therein or thereon (Collectively the "Activity Premises").
2. I hereby RELEASE Rain Creek Ranch, Anderson, Tuggle, and Anderson Families of 1755 PR 506 Menard, Texas 76825 and his or her personal representatives, heirs, assigns, executors, administrators, partners, joint venture's employees, agents, contractors and next of kin (collectively, the "Releases") from and against any and all liability for any loss, damage, injury, expense, demand or cause of action that I may suffer whether with respect to personal injury, death, damage to or destruction of property, theft or otherwise, which may arise as a result of my presence in, upon or about the Activity Premises or my use of the Activity Premises.
3. I will indemnify and hold harmless the Releases, collectively and individually, from any losses, liabilities, damage, demands, costs, causes of action and express that they may incur, for any reason whatsoever, which may arise as a result of my participation in the Activity, and my presence in, upon or about the Activity Premises.

I HAVE READ THE FOREGOING RELEASE, WAIVER, INDEMNIFICATION, & REGULATIONS AGREEMENT. You have been given reasonable opportunity to discuss this with my legal counsel. I FULLY AND UNDERSTAND ITS TERMS AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCMENT.
